The terms ‘website,’ ‘us,’ ‘we,’ ‘our,’ ‘management,’ or ‘management committee’ refer to www.shubhamworld.net. The term ‘you’ refers to the ‘user,’ ‘viewer,’ ‘visitor,’ ‘subscriber,’ or ‘guest’ of our website. By continuing to browse and use this website, you agree to comply with and be bound by the following terms and conditions, which together with our Privacy Policy govern your relationship with us in relation to this website.

Use of This Website

The use of this website is subject to the following terms of use:

  • Estimates/Quotes: All estimates/quotes are based on our understanding of your requirements and the provided time frame. Any changes to the functionality, including minor improvements, may incur additional costs. Ensure clarity in a face-to-face meeting or phone discussion.
  • Acceptance of Quote: By accepting a quote, you agree to the terms and conditions of Shubham World. Acceptance can be verbal, via email, payment of initiation, or signing the quote.
  • Client Responsibility: You are responsible for ensuring that all requirements are included in the quotes and fully understood by us. Provide clear guidelines and specific details for accurate quotations. If discrepancies arise, additional costs may apply.
  • Bugs: Bugs or programming errors reported during or just after development will not attract additional charges.
  • Re-work and Changes: Any re-work on completed tasks or design changes after approval will incur additional charges. Similarly, modifications during or after Go-Live approval will incur additional charges.
  • Content Delivery: All website/application content should be provided within two days of starting the project. Any delays after that may delay the project.
  • Responsive Testing: Responsive/multi-device compatibility is tested on Android phones and Windows computers. Testing on other devices should be discussed in advance.

Annual Maintenance Terms

  • Maintenance Package Duration: All maintenance packages are for a minimum of 12 months.
  • Payment: Maintenance packages are billed annually but are paid monthly via direct debit on the 1st of each month.
  • Inclusions: Packages may include basic hosting, email hosting, and DNS hosting. The maintenance service covers only maintenance tasks and excludes full redesigns or major functionality add-ons.

Fees and Deposits

  • Initial Payment: A 50% or INR 5,000 deposit, whichever is higher, is due immediately upon you instructing us to proceed with the website work. The remaining 50% is due once the work is completed to your satisfaction, subject to the “approval of work” and “rejected work” clauses.
  • Refund Policy: The deposit is refundable only if we fail to deliver the required work. If development has started, the deposit is non-refundable unless the cancellation is due to our fault.
  • Cancellation: If the order is canceled before work commences, 75% of the deposit will be refunded. After work has commenced, a maximum of 50% refund will be provided. No refunds are available if more than 50% of the work has been completed.

Approval and Rejected Work

  • Approval of Work: Upon completion, you will be notified and have the opportunity to review the work. Any unsatisfactory points must be reported within 7 days. After that, the work will be deemed approved.
  • Rejected Work: If you reject work within the 7-day period, and we consider the rejection unreasonable, we reserve the right to treat the contract as complete and pursue payment for completed work.

Variations

  • Revisions and Changes: We offer a reasonable number of revisions. However, any major deviation from the original specification will incur an additional cost starting from INR 599.00 per hour.
  • Failure to Provide Content: If you fail to provide required content on time, we may charge up to 25% as a surcharge or close the project, with the remaining balance payable immediately.

Intellectual Property

  • Copyright: You retain the copyright to materials provided to us. You must ensure that you have permission to use third-party copyrighted materials. Shubham World is indemnified against any claims resulting from unauthorized use.
  • Intellectual Property: Except as specifically outlined in the license, you do not acquire any intellectual property rights relating to the content of this site, including software or information.

Liability

  • Missed Deadlines: We are not liable for any missed deadlines caused by your late submission of materials or failure to approve work on time.

Hosting

  • Reliable Hosting: We host client websites on a high-speed cloud server with a guaranteed uptime of 99%. Details are available upon request.

General Terms

  • Project Commencement: Upon quote acceptance and payment initiation, the project starts. Design mock-ups will be provided for your review within 5 to 10 working days.
  • Finalization and Updates: Once the design is approved, we proceed with development. Content can be transferred from the old website, and further updates are your responsibility post-launch.
  • Responsibility for Backup and Updates: Post-launch, you are responsible for taking regular backups and updating third-party software.
  • Additional Costs: Any features or design changes outside the initial scope will be agreed upon and invoiced before going live.
